Thank you for your interest in the C2C Home Loans FSBO program. By clicking a registration or new account submission, or using C2C Home Loans websites, networks, mobile applications, or other services provided by C2C Home Loans or accessing any content provided by C2C through the Services, you agree to be bound by the following user agreement.

1. Clear 2 Close Home Loans – DOES NOT PROVIDE FINANCIAL OR REAL ESTATE ADVICE. C2C IS a MORTGAGE LENDER You understand and agree that the Services may include advertisements, and that these are necessary to support the Services. To help make the advertisements relevant and useful to you, C2C may serve advertisements based on the information we collect through the Services. See the Privacy Policy for more details. C2C assumes no responsibility for any result or consequence related directly or indirectly to any action or inaction that consumers take based on the Services or any other information available through or in connection with the Services.

2. Eligibility; Accounts and Registration. You must be 18+ years of age to use the Service. Agreeing to USER AGREEMENT, you represent that: (a) you are at least 18 years of age; (b) you have not previously been suspended or removed from the Services; and (c) your registration and your use of the Services is in compliance with all applicable laws and regulations. When you register for an account, you may be required to provide us with some information about yourself, such as email address or other contact information. You agree that the information you provide is accurate.
3. Use of Services and other Restrictions.

• Use of the Services. As long as you comply with this USER AGREEMENT, C2C grants you a nonexclusive, limited use of the Services, and to download and use any App, on your mobile device in for your use. If you are a real estate or mortgage professional acting in your professional capacity, you may additionally use the Services to provide information, to the extent permitted by applicable law, to your clients and to take actions on behalf of your clients. If you are a real estate professional or mortgage professional, you certify you have obtained all required authorizations/consents from client. User agreement does not provide you with a license to use, reproduce, distribute, display or provide access to any portion of the Services on third-party web sites or otherwise.
• Any mobile application feature must have a compatible mobile device. C2C does not guarantee that any App will be compatible with your mobile device. You may may incur additional charges from your wireless provider for using an App. You agree that you are solely responsible for any applicable charges. You consent to all automatic upgrades, and understand that these Terms of Use will apply to all updated versions of an App.
• Use of Content. Subject to the restrictions set forth in these User Agreement, you may copy information from the Services only as necessary for your personal use or Professional use to view, save, print, fax and/or e-mail such information. If you copy or use material in C2C website, C2C will receive full credit in all occurrences.

4. USING THE SERVICES, YOU AGREE NOT TO:

• Modify any copyright or other intellectual property notices that appear in the Services or use any copyrighted material appearing elsewhere online without the proper permission from copyright owner.
• Use the Services for resale, service bureau, time-sharing or other similar purposes;
• Use the Services in any way that is unlawful, or harms C2C, its service providers, suppliers, clients.
• Distribute or post spam, chain letters, pyramid schemes, or similar communications through the Services;
• Impersonate another person or misrepresent yourself
• Use information on C2C website without permission from authorized C2C representative.
• Upload invalid data, viruses, worms, or other software agents to the Services or other malicious cyber acts.
• Use any of C2C trademarks as part of your screen name or email address on the Services.
• Attempt to, or permit or encourage any third party to, do any of the above.

5. Fees.

Any fees are in U.S. dollars changes. Certain fees may be non-refundable. If you pay any fees with a credit card, C2C may seek pre-authorization.

6. User Materials.

• License Grant. C2C FSBO Services requires users to upload images, photos, video, data, text, and other content. By uploading these items, you grant C2C an irrevocable, perpetual, royalty-free worldwide license to: (i) use, copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, modify, prepare derivative works of or incorporate into other works, and translate your User Materials, in connection with the Services, or in any other media; and (ii) sublicense these rights, to the maximum extent permitted by applicable law. C2C will not pay you for your User Materials or to exercise any rights related to your User Materials set forth in the preceding sentence. C2C may remove or modify your User Materials at any time. You are solely responsible for all materials made through your user account(s) on the Services or that you otherwise make available through the Services you represent that you are the creator and owner of the User Materials, or have the necessary licenses, rights, consents, and permissions (including all permissions required under applicable privacy and intellectual property law) to authorize C2C and other users to access and use your Materials as necessary to exercise the licenses granted by you under these Terms of Use.
• C2C does not control your uploaded photos, etc., or any other user and will not be in any way responsible or liable for any user uploads. C2C, at any time and without notice can screen, remove, edit, or block any information that may be viewed as objectionable. Any upload information cannot be inaccurate, offensive, indecent, or objectionable. You agree to waive any  legal or equitable right or remedy you may have against C2C. If notified by a user or content owner that uploaded information allegedly do not conform to user agreement, C2C will determine whether to remove said information. C2C reserves the right to do at any time and without notice

7. 3rd Party Collaboration

• Third-Party Providers are exclusively responsible for their services. If you utilize a 3rd party, you will need to vet said party and are responsible for third party results. C2C does not endorse, and takes no responsibility for Third-Party Providers. By using the C2C FSBO system, you may receive telemarketing calls from the Third-Party Provider using the contact information you provided. Third-Party Providers may keep your contact information and any other information received by the Third-Party Provider in processing a contact or other request form. C2C bears no responsibility for any damages or costs way connected with your dealings with these third parties.
• Certain Third-Party Services. Mortgage Products; If you include your name, contact information and other information in a request, your identity will no longer be anonymous to C2C/ Third-Party Provider. Your submission of information and any request for quotes is an application for credit. C2C provides mortgage loans for residential and commercial properties and will utilize any information provided in connection with a mortgage loan application. By using these features, the disclosures and consent required under certain state laws are deemed to be provided, received, and agreed to. Interest rates displayed through the Services are for information purposes only and reflect non-binding. Actual interest rates may vary. Loan approval standards are established and maintained solely by individual Lenders. Consumers should rely on their own judgment in deciding which available loan product, terms.

Rental Products. If you choose to submit your information in order to submit a background or credit check, you are subject to the Checker and Experian terms as described in Section 8(C) below. C2C cannot guarantee landlord accepting tenant.

Intellectual Property. The Services are owned and operated by C2C. All aspects of the services provided on website are intellectual property of C2C. C2C reserves all rights to the materials and services on website.

Intellectual Property Notices:

Any use of these images and descriptions is subject to the copyright owner’s permission and the requirements of applicable law.

Feedback. If you provide input and suggestions regarding the services, then you hereby grant C2C an unrestricted, perpetual, irrevocable, non-exclusive, fully-paid, royalty-free right to use the Feedback in any manner and for any purpose.

C2C respects the intellectual property rights of others. Anyone who believes that their work has been reproduced may notify C2C Headquarters.

Upon notice of copyright infringement by e-mail, we may begin investigating the alleged infringement; however, we must receive your signed statement by mail or as an attachment to your e-mail before we are required to take any action.

Termination/Changes to Agreement. – You can terminate your use at any times. If there are any fees due at time of termination they will need to be paid. Terms of User Agreement may change at C2C discretion.

Privacy Policy

1. Privacy Policy. C2C will collect, use, store, and disclose personal information in accordance with its Privacy Policy. Please consult the Privacy Policy.
2. Use of the Services is subject to all guidelines, rules, and agreements. Indemnification. You agree to hold harmless C2C & its affiliates, and their respective directors, officers, employees, and agents from all claims and demands made by any third party due to or arising out of: (a) your access to or use of the Services; (b) your breach of these Terms of Use; (c) your violation of any law or the rights of a third party; (d) any dispute or issue between you and any third party; (e) any materials you upload to, or otherwise make available through, the Services; (f) your willful misconduct; and (g) any other party’s access to and/or use of the Services using your account and password. C2C reserves right to have private representation if there are any issues.

No Warranties. SERVICES “AS IS. There are no guarantees of services, and or your satisfaction with services.

Limitation of Liability;

C2C OR ANY OF ITS AFFILIATES will not BE LIABLE FOR;

• ANY INDIRECT OR PUNITIVE DAMAGES from this User Agreement
• Any breach of contract resulting from listing FSBO or default of payment from buyer to seller. C2C does not advise or conduct real estate transactions. All Real Estate Transaction should seek advice from an attorney.
• Any injuries incurred by users viewing a FSBO or issues arising after a potential buyer visits a FSBO home.
• Illegal conduct by users, potential buyers or 3rd party vendors.
• Any business not conducted ethically and morally and/or in violation of law.

You agree to conduct your use of services provided by C2C in accordance to the law, any violation of law, codes of ethics and morality will be viewed as a violation of the User agreement and will terminate the user automatically. This is at the full discretion of C2C.

Consent to Electronic Communications, you consent to receiving certain electronic communications from C2C as described in the Privacy Policy. Please read the Privacy Policy. You consent that any notices, agreements, disclosures, or other communications C2C sends to you electronically will satisfy any legal communication requirements, including that those communications be in writing. You agree to receive any and all emails from C2C and vendors. You agree to opt out if you elect not to receive these emails.
